IMPORTANT: Section 13 requires most disputes to be resolved by binding individual arbitration, not in court, and waives class actions and jury trials. You can opt out within 30 days. See Section 13.
These Terms of Use (“Terms”) govern your use of Yoga Roulette™ and any Yoga Roulette apps (together, the “Service”). The Service is operated by East Coast CAD LLC (“East Coast CAD,” “we,” “us”), a Maryland limited liability company. By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Yoga and medical disclaimer
Yoga Roulette suggests yoga poses at random and gives general yoga guidance for information and personal wellness. It is not medical advice, and it does not replace a physician, physical therapist, or qualified yoga teacher.
Check with your physician first. Talk to your physician before you start any new exercise program, especially if you are pregnant, injured, recovering from surgery, have a health condition, or have not exercised in a while.
Scale every pose to you. Hold times, levels, and form cues are general suggestions. Use the easier options freely, and skip any pose that is not right for you.
Stop if something is wrong. Stop right away if anything hurts, or if you feel dizzy, numb, or short of breath. If symptoms are severe or do not go away, call 911 or your local emergency number.
Harder poses. Poses under “More challenge” (such as Headstand, Shoulder Stand, and arm balances) are only for people who have practiced them before, ideally with a teacher. Use a wall and a soft surface.
Images show the idea, not every detail. Photos and cues illustrate a pose. They may not cover every safety point for your body.
2. Who can use the Service
You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, use the Service only with the permission and supervision of a parent or guardian.
3. Your license
Subject to these Terms, East Coast CAD grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal wellness and for no commercial purpose.
4. Ownership and trademarks
The Service, including its software, design, pose library and its compilation, coaching text, and other content, is owned by East Coast CAD LLC or its licensors and is protected by copyright, trademark, and other laws. Iron Roulette™, Yoga Roulette™, SPIN. TRAIN.™, and the related names and logos are trademarks of East Coast CAD LLC. You may not use them without our written permission.
Some components, such as photos used under their own licenses and open-source software, remain subject to those licenses. Photo credits appear in the app files.
5. Acceptable use
When you use the Service, you agree not to:
- copy, scrape, crawl, harvest, or bulk download the pose library, images, or other content, by automated means or otherwise;
- reverse engineer, decompile, or disassemble the Service, except to the extent applicable law expressly allows despite this restriction;
- interfere with or disrupt the Service or its servers, probe or bypass its security, or overload it;
- frame, mirror, resell, sublicense, or commercially exploit the Service or its content, or use either to build a competing product or dataset;
- remove or change any copyright, trademark, or other notice; or
- use the Service in any unlawful way or to infringe anyone’s rights.
6. Feedback
If you send us ideas or feedback, we may use them without any obligation to you.
7. Third-party services
The Service relies on your browser and on third-party services, such as content delivery networks and hosting providers. Those services are governed by their own terms and policies, and we are not responsible for them.
8. Preview and changes to the Service
This is a preview version. Features may change or stop working. We may change, suspend, or discontinue any part of the Service at any time, including its features, poses, and levels.
9. Termination
You may stop using the Service at any time. We may suspend or end your access at any time if you violate these Terms or if we need to protect the Service or its users. Sections 1, 4, 5, and 10 through 16 continue to apply after your use of the Service ends.
10. No warranty
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the Service will be uninterrupted or error-free, that its content is complete or accurate, or that any pose it suggests is suitable or safe for you.
11. Assumption of risk and release
Exercise and yoga carry a risk of injury, including serious injury. You choose your workouts, levels, poses, weights, and how hard you push, and you voluntarily assume all risks. To the maximum extent permitted by law, you release East Coast CAD LLC and its members, managers, employees, and licensors from any claims for injury, illness, or damage arising out of your exercise or use of the Service.
12. Limitation of liability
To the maximum extent permitted by law, East Coast CAD LLC and its members, managers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any personal injury, loss of data, or lost profits, arising out of or related to your use of the Service or any exercise you perform, even if we were told such damages were possible. To the maximum extent permitted by law, our total liability for all claims related to the Service is limited to the greater of fifty U.S. dollars (US$50) or the amount you paid us to use the Service in the twelve months before the claim. Some jurisdictions do not allow certain exclusions or limitations of liability, so some of these may not apply to you. Where that is the case, they apply to the fullest extent the law permits.
13. Dispute resolution: binding arbitration and class action waiver
Talk to us first. Before starting a claim, email info@eastcoastcad.com with your name, a description of the problem, and what you want. Both sides agree to try in good faith to settle it within 60 days.
Binding arbitration. If we can't settle it, you and East Coast CAD LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any purchase, or any exercise or activity you perform using the Service (including claims of personal injury, and including whether this section applies) will be resolved by final and binding arbitration, not in court. The arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. It may be held by video, phone, or written submissions, or in person in Harford County, Maryland, or in the county where you live. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction.
No class actions. You and East Coast CAD LLC may bring claims against each other only in an individual capacity, never as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not combine more than one person's claims and may award relief only to the individual party asking for it. If this class action waiver is found unenforceable for a claim, that claim (and only that claim) goes to court, and it stays paused until the individual arbitration is finished.
Jury trial waiver. You and East Coast CAD LLC both waive any right to a jury trial.
Exceptions. Either side may bring an individual claim in small claims court in Maryland if it qualifies. Either side may also go to court to stop infringement or misuse of its intellectual property.
Costs. Fees follow the AAA Consumer Rules. For claims under $10,000 that are not frivolous, we will pay your AAA filing fee.
Time limit. Any claim must be brought within one (1) year after it arises, or it is permanently barred, to the extent the law allows.
30-day opt-out. You can opt out of this arbitration section by emailing info@eastcoastcad.com within 30 days after you first accept these Terms, with the subject "Arbitration Opt-Out" and your name and the email address you use with us. Opting out does not affect any other part of these Terms.
Changes. If we change this section, the change won't apply to a claim you already gave us notice of before the change.
14. Indemnity
You agree to defend, indemnify, and hold harmless East Coast CAD LLC and its members, managers, and employees from any claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Service or your violation of these Terms.
15. Governing law and venue
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. Subject to Section 13 (Dispute resolution), any dispute arising out of or relating to these Terms or the Service that is not resolved by arbitration, including small-claims cases, claims of anyone who opted out of arbitration, and anything else not covered by arbitration, will be brought exclusively in the state or federal courts located in the State of Maryland, and you and East Coast CAD consent to the personal jurisdiction of those courts.
16. General
These Terms and our Privacy Policy are the entire agreement between you and East Coast CAD about the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the new version on this page and change the date at the top. If we change these Terms, the app will ask you to accept them again.
